TERMS AND CONDITIONS
I believe in creating a better version of ourselves through self-development, self-love, and self-worth. However, this transformation doesn't occur overnight and requires dedication and commitment. The journey to success involves a consistent investment of time, energy, and resources to acquire the necessary self-awareness and tools to overcome any challenges or obstacles.
Elle requires clients to be fully committed to themselves and willing to embrace discomfort, tackle resistance, and receive support from her to achieve their desired results.
SESSION & COMMUNICATION EXPECTATIONS FOR SESSIONS:
It is the client's responsibility to book their sessions. Please arrive ON TIME (either in person or call Elle by Zoom or phone) at your scheduled appointment. Sessions started late may need to be ended at the scheduled time in consideration of those with appointments following your session.
Elle will send her address or Zoom link 24 hours before the session.
Elle is committed to communicating with all clients often and being in constant communication between sessions to create maximum results. Elle will send a few follow-up messages and encourage you to continue to Self-Havening when required.
TERMS & CONDITIONS FOR SUPPLY OF SERVICES – Elle Louise Mcbride
INTERPRETATION: In this document, the following words shall have the following meanings:
1.1 "Client" means any person who purchases Services from the Trainer/Practitioner;
1.2 "Trainer/Practitioner" means Elle Louise Mcbride trading as “Elle Louise Mcbride pty ltd” A.B.N. 23463253659;
1.3 “Services” means the provision of coaching in a single Session or a Programme consisting of multiple Sessions, as tailored for the Client by the Trainer/Practitioner;
1.4 “Agreed Payment” means the amount to be paid by the Client for the Session or Programme as agreed when the Session or Programme is discussed and organised, and as confirmed in writing by the Trainer/Practitioner.
1.5 "Terms and Conditions" means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by the Trainer/Practitioner.
GENERAL
2.1 These Terms and Conditions shall apply to all contracts for the supply of Services by the Trainer/Practitioner. By paying the Agreed Payment, the Client acknowledges and agrees to these Terms and Conditions.
2.2 These Terms and Conditions shall apply once a Client has made the Agreed Payment for the relevant Session or Programme to the Trainer/Practitioner.
2.3 These Terms and Conditions may be varied, but only if so agreed in writing by the Trainer/Practitioner.
AGREED PAYMENT AND PAYMENT
3.1 Payment of the Agreed Payment for a Session shall be made prior to the Session. If the Agreed Payment is not received at the time of the session, the session will not proceed. Unless payment is made prior to the client leaving the session and prior approved.
3.2 Payment of the Agreed Payment for a Programme consisting of multiple Sessions, shall be made as agreed by the Trainer/Practitioner and Client when arranging that Programme.
3.3 The Trainer/Practitioner reserves the right to charge a Deposit for a Programme.
3.4 Payments shall be made to the bank account, or via the booking link if the Trainer/Practitioner advised in the message sent by the Trainer/Practitioner to confirm arrangements with the Client.
3.5 The Client agrees to include their name as a payment reference to allow the Trainer/Practitioner to identify the payment from the Client.
3.6 The preferred payment option is electronic funds transfer (EFT) to the account provided in the welcome message. Alternatively, Paypal is also acceptable. Paypal charges a 6% fee which is passed through to the Client so should you elect this option, this fee is added to the Agreed Payment.
CANCELLATIONS AND NO SHOW
4.1 Cancellations and/or rescheduled appointments will be accepted if made at least 24 hours prior to the appointment.
4.2 The Agreed Payment (or part thereof in relation to a Programme) shall be forfeited where:
(i) cancellation is less than 24 hours prior to the relevant appointment; or
(ii) the Client does not show-up for the relevant appointment.
REFUNDS
5.1 There are no refunds. Any exception to this policy is solely at the discretion of the Trainer/Practitioner.
5.2 All potential Clients are invited to ask for a demonstration of the Services if they are unsure what a Session involves or what to expect.
5.3 Should the session or programme not meet the Clients value expectations, the Trainer/Practitioner agrees to a refund or partial refund, the maximum of any refund shall be the Agreed Payment for that Session less any direct expenses of the Trainer/Practitioner in providing that Session.
5.4 For bundle sessions or Coaching containers of any form, there is a strict no refunds policy. Clients are encouraged to use all sessions within the bundle.
PUNCTUALITY
The parties acknowledge that delays can be part of life and agree that:
(i) where either party is less than fifteen (15) minutes late, the Session shall extend for that amount of minutes, if possible, or if not possible for the Client or Trainer/Practitioner, that amount of minutes shall be added to the next Session of that Client.
(ii) where either party is more than fifteen (15) minutes late, the Session is cancelled and the Client shall be entitled to rebook the Session and if they choose not to rebook the Session, the payment for that Session will be lost.
INTELLECTUAL PROPERTY
7.1 Lots of love, time, energy and funds, have been invested by the Trainer/Practitioner into the Services (both as to content and method of delivery) and the Client acknowledges that the content and method of delivery of the Services is intellectual property of the Trainer/Practitioner (or another party) and shall not be replicated, copied, distributed or sold in breach of the clause.
7.2 Any written material produced by the Trainer/Practitioner is subject to copyright protection. The Client acknowledges that the Trainer/Practitioner has not and will not waive this copyright protection and the Client specifically acknowledges that such written materials will not be copied for the purpose of distribution or otherwise without consent of the Trainer/Practitioner.
Havening Techniques® Practitioner Training
8.1 Elle Louise McBride offers Havening Techniques® Practitioner Training, designed to equip participants with the knowledge and skills to practice Havening Techniques® professionally.
8.2 Training includes:
Comprehensive instruction on the science and methodology of Havening Techniques®.
Hands-on practice and feedback during training sessions.
Access to training materials, including manuals and resources.
8.3 Participants must meet all requirements and complete assessments to become certified Havening Techniques® Practitioners. Certification is issued by the Havening Techniques® organization and is subject to their terms and conditions.
8.4 Payment for training must be made in full or according to the agreed payment plan prior to the commencement of the training.
8.5 Refunds for training are subject to the cancellation and refund policy outlined in section 4.
8.6 Elle Louise McBride is not liable for participants’ inability to complete the certification process due to non-compliance with requirements or external circumstances beyond her control.
CONFIDENTIALITY
9.1 Information shared (both from Client to Trainer/Practitioner and Trainer/Practitioner to Client) within a session is subject to strict confidentiality. The parties expressly acknowledge this for the purpose of creating a safe haven & healing space.
LIABILITY
10.1 By paying for a Session or Programme, the Client automatically waives, releases and discharges from any and all liability, including but not limited to negligence or fault of the Trainer/Practitioner, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to the Client or his or her property, including travelling to or from a Session.
10.2 The Client indemnifies and holds the Trainer/Practitioner and her affiliates or employees, harmless and will not sue them for negligence or otherwise.
10.3 The Trainer/Practitioner is not a licensed doctor and therefore does not diagnose, prescribe or treat diseases or illnesses. The Services are not a substitute for professional medical advice and are for informational or educational purposes only. Always seek the advice of your doctor or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information you accessed through any Session or Programme. It is the intention of the Trainer/Practitioner to provide professional coaching Services aligned with the highest level of integrity and professionalism and guarantees and warranties of any kind cannot be and will not be given or promised.
11. VALUE
11.1 The Client is responsible for “getting value” from the Trainer/Practitioner, and specifically acknowledges his or her right to have a demonstration of the Services in paragraph 5.2 above.
11.2 In the unusual event that the Client does not consider value was received and the Trainer/Practitioner agrees to a refund or partial refund, the maximum of any refund shall be the Agreed Payment for that Session less any direct expenses of the Trainer/Practitioner in providing that Session.
12. HARASSMENT
12.1 The parties acknowledge that harassment of any kind, that being aggressive, sexual or anti-social behaviour, will not be implemented or tolerated by either party.
12.2 The Trainer/Practitioner is committed to upholding values of integrity and mutual respect, which includes zero tolerance towards harassment and any behaviour that is out of alignment with integrity.
12.3 The Trainer/Practitioner and her staff are committed to creating a safe and enjoyable environment where healing can take place and wellness can begin.
13. SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed, and the remainder of these Terms and Conditions shall remain in full force and effect.
14.GOVERNING LAW
These Terms and Conditions shall be governed by, and construed in accordance with, the laws of Queensland, Australia. The parties agree to submit to the exclusive jurisdiction of the courts of Queensland, Australia, for any dispute arising out of these Terms and Conditions.
15. ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between the Client and the Trainer/Practitioner and supersede any prior agreements or understandings, whether written or oral, regarding the subject matter hereof.
16. AMENDMENTS
The Trainer/Practitioner reserves the right to amend, modify, or change these Terms and Conditions at any time. Any amendments will be communicated to the Client in writing.

By making a payment for any Service provided by the Trainer/Practitioner, the Client acknowledges and agrees to abide by these Terms and Conditions.
